Landlords,
innkeepers, storekeepers and individuals have a duty to keep their
premises in good condition for the safety of permitted users.
They may also have a duty to protect you from the criminal actions
of third parties while you are present on those premises.
Some premises owners, such as innkeepers, owe a higher duty of
care to guests than do other potential defendants making a recovery
more likely. As an example, Delano Law Offices, P.C. recovered
against a motel when a guest was beaten, robbed and left bound
in a stairway. Another successful recovery involved the attempted
theft of a hotel guest's purse while she was crossing the parking
lot. In that case the thief, who was never apprehended, slashed
her arm to cut her purse strap severing muscles, nerves and tendons.
A more unusual example of a heightened duty of care was based
upon the successful argument of Delano Law Offices, P.C. that
the operator of a Ferris Wheel in an amusement park was a common
carrier. In that case a moblie crane used to erect rides was left
parked on a hillside and a prankster apparently released the brakes
allowing it to roll down hill into the Ferris Wheel thus injuring
our client.
Delano Law Offices, P.C. has attorneys experienced in identifying
potential defendants and causes of action. "It hasn't been
done that way before" is never cause to fail to pursue a
novel cause of action for our clients.
