Most
workers are aware that the Worker's Compensation Act gives them
a measure of protection when injured while at work although many
do not realize they may have sources of recovery other than under
worker's comp.
Although a worker's "sole remedy" against his employer
is ordinarily under worker's comp, there may be other entities
liable. Delano Law Offices, P.C. recovered $180,00 against the
owner of the premises and a demolition contractor when a laborer
was injured and that recovery was above and beyond his worker's
comp award. In another action we recovered against the contractor
who built a building over nine years previously when a worker
using that building was injured when a defectively designed railing
gave way.
