Most workers are aware that the Worker's Compensation Act gives them a measure of protection when injured while at work although many do not realize they may have sources of recovery other than under worker's comp.

Although a worker's "sole remedy" against his employer is ordinarily under worker's comp, there may be other entities liable. Delano Law Offices, P.C. recovered $180,00 against the owner of the premises and a demolition contractor when a laborer was injured and that recovery was above and beyond his worker's comp award. In another action we recovered against the contractor who built a building over nine years previously when a worker using that building was injured when a defectively designed railing gave way.

Such third party actions may not always be obvious to someone injured on a worksite. Your best recourse is to speak with attorneys experienced in such actions who know how to deal with the complexities of balancing the special issues of concurrent worker's compensation and third party actions.
